Zimmerman Case – Judge Kenneth Lester Disqualified

The 5th District Court of Appeals ruled in favor of George Zimmerman and ordered Judge Kenneth Lester to enter an order of disqualification. The ruling was quick to the point.

“Although many of the allegations, standing alone, do not meet the legal sufficiency test, and while this is admittedly a close call, upon careful review we find that the allegations, taken together, meet the threshold test of legal sufficiency.”

It is now up to the Chief Circuit Judge to appoint a successor Judge. It is obviously too early to know how the new Judge will handle this case, but this is a big win for Zimmerman. Regardless of what the outcome of this case eventually is, the Defense beat the Prosecution in this round. More than that, the Defense’s logic was sound in this panel’s eyes and the State Attorney General’s Office’s response was insufficient.

Update – April 30th, 2012 3:45 PM: Judge Debra S. Nelson has been assigned as the new Judge in the Zimmerman case. Coincidentally, she is also presiding over Shellie Zimmerman’s perjury case.

It looks like Judge Nelson scored below Judge Lester in the recent Judicial Poll that was released.

    We both called it, but you put more confidence in your call, so you get some extra points. 😉

    Judge Nelson gets *relatively* low marks on stuff. Lowest on demeanor, and the comment about her weren’t very positive. (My neck still hurts from reading it.)

    Most judges don’t seem to be particularly good judges to me (fair, impartial, not assholes, etc.) I’ve only dealt with one personally in small claims court, but based on attorney’s comments, as well as just observing what I read about them or watch on T.V.

    I have no problems with stiff sentencing on certain crimes.. so I’m not sure I hold that against her. And at least some of the dislike of her comes from that. If that were the only thing I wouldn’t be worried. I just want her to be impartial, unbiased, and not let political pressure s(especially as it relates to her ambitions) affect her decisions (particularly on SYG). The political pressure aspect though is kind of the killer. It’s why he got charged in the first place. It’s what has driven the whole prosecution. Of course, the decision to prosecute was made at the height of anti-Zimmerman sentiment. Many people no longer feel that way now. And there aren’t nearly as many Trayvonites as it seems. (They are just extremely vocal). Hard to say. She looks like a b*tch to me though. Hopefully, I’m wrong.
